
Complaints and DisputesComplaints and disputes can arise from buying a product or a service that the buyer considers is not fit for purpose. Legislation exists to protect the buyer of any type of goods or service, regardless of quality or description, with a claim being possible where the product or service does not match its description sufficiently. Solicitors are able to give you legal advice that is quick and straightforward, in cases where you are simply seeking a replacement or a refund of a relatively low value product or service. In some cases, you may be able to issue court proceedings to claim for any injuries resulting from a faulty product or service, for which further advice may be required. However, such advice may, in fact, be available on a 'no win, no fee' basis, eliminating much of the risk for a claimant. Some service disputes may be easier to resolve due to the existence of industry bodies such as ATOL, who protect holidays, and who may be able to refund the cost of the holiday if your tour operator becomes insolvent. Claims can also be made against professionals such as accountants, surveyors or even against fellow solicitors. However, these disputes are often settled out of court to avoid damage to reputation. |
